Understanding Chevy Lemon Law

Michigan and Ohio both have clear lemon laws designed to protect consumers from defective vehicles that fail to meet basic standards of quality and reliability. As one of the most popular automotive brands in the country, Chevrolet produces millions of vehicles annually. However, not every car, truck, or SUV meets the standards and specifications.

If your Chevy has a substantial defect that impacts its value, safety, or use, and the dealership or manufacturer hasn’t successfully repaired the issue within a reasonable period, you may qualify for lemon law protections. In both Michigan and Ohio, the lemon law potentially applies to new Chevrolet models, including but not limited to:

  • Chevrolet Silverado (1500, 2500, 3500)

  • Chevrolet Tahoe

  • Chevrolet Suburban

  • Chevrolet Equinox

  • Chevrolet Traverse

  • Chevrolet Malibu

  • Chevrolet Bolt EV

  • Chevrolet Camaro

  • Chevrolet Corvette

Remember, lemon law applies to new and leased vehicles that are still covered under the manufacturer’s warranty. If your Chevy is used or leased, defects that arise during the warranty period typically do not qualify for legal recourse under the lemon law (there are other laws that apply to used vehicles).

What Defines a “Lemon”?

Generally, a new purchased or leased Chevrolet may be considered a lemon if it exhibits a significant defect that cannot be repaired within a specified time frame or after a certain number of repair attempts. To qualify as a lemon, generally, the car must:

  • Have a significant defect that is covered by the warranty that occurred within a specific period or after a number of miles traveled.

  • Have a substantial defect that can't be fixed after a reasonable number of repair attempts.

  • Have spent 30 days or more at the dealership for repairs within the first year of purchase.

In Ohio, additional provisions include eight or more repairs in an effort to fix various problems or one attempt to repair a defect that was likely to cause death or serious injury. For example, if you purchased a 2023 Chevy Silverado and it repeatedly experiences transmission failures that render the vehicle unsafe to drive, and the dealership is unable to resolve the issue after multiple visits, your Silverado may qualify as a lemon.

Think You Have a Lemon?

Potential Compensation for Chevy Lemons

If your Chevy qualifies as a lemon, you typically have two remedies available to you. These include a vehicle buyback or a replacement vehicle. However, the best option for you will depend on your preferences and specific circumstances.

  • Vehicle buyback: If your Chevy qualifies as a lemon, you may be eligible for a full refund of your purchase price, including taxes, registration fees, and more.

  • Replacement vehicle: If a buyback is not a suitable option, you may choose to receive a comparable new or defect-free Chevrolet vehicle as a replacement for your lemon.

Depending on the circumstances, many manufacturers offer cash resolutions, where you'd keep the car. Sometimes this makes sense, other times, it doesn't.

Additionally, under Michigan and Ohio lemon laws, manufacturers are also typically required to cover your legal fees and expenses, meaning you can pursue legal action without worrying about out-of-pocket costs for your attorney.
